FINES UP TO 100 MILLION IF UNTREATED WASTE IS DISCHARGE

According to the regulations, the penalty for illegal discharge of untreated wastewater into the rainwater drainage system of industrial zones, export processing zones, hi-tech parks and industrial clusters can be up to 100 million VND.

According to Clause 6, Article 12 of Decree No. 155/2016/ND-CP on sanctioning of administrative violations in the field of environmental protection, which have been promulgated by the Government, acts of violating the regulations on environmental protection in industrial zones, export processing zones, hi-tech parks and industrial clusters will be sanctioned in three levels.

Specifically, a fine of from 10,000,000 to 20,000,000 VND shall be applied for acts of failing to perform or improperly perform the environmental protection regulations of investors constructing and making business in infrastructures of industrial zones, export processing zones, hi-tech parks and industrial clusters.

Subsequently, a fine of from 20,000,000 to 50,000,000 VND shall be applied for acts of discharging wastewater with one of the environmental parameters exceeding from 10% to 20% of the wastewater-receiving norm of the investors constructing and making business in infrastructure of industrial zones, export processing zones, hi-tech parks and industrial clusters; The fine is increased by 10% of the fine level prescribed at this point for cases where wastewater level exceeds 20% to 30%; The fine is increased by 20% for cases where wastewater level exceeds from 30% to 40%; The fine is increased by 30% for cases where wastewater level exceeds from 40% to 50%; The fine is increased by 40% for cases where wastewater level exceeds from 50% to 60%; The fine is increased by 50% for cases where wastewater level exceeds from 60% to 70%; The fine is increased by 60% for cases where wastewater level exceeds from 70% to 80%; The fine is increased by 70% for cases where wastewater level exceeds from 80% to 90%; The fine is increased by 80% for cases where wastewater level exceeds from 90% to 100%; The fine is increased by 90% for cases where wastewater level exceeds more than 100%.

The third level is a fine of from 50,000,000 to 100,000,000 VND for acts of illegally discharging untreated wastewater into rain water drainage systems of industrial zones, export processing zones, hi-tech parks or industrial clusters. Particularly in this case, functional agencies shall suspend the activities of polluting the environment of industrial zones, export processing zones or hi-tech parks from 6 months to 9 months.
